INDONESIA’S ONLINE GAMBLING REGULATIONS: A COMPARATIVE ANALYSIS WITH BENCHMARKING AGAINST INTERNATIONAL BEST PRACTICES

Abstract

The purpose of this research is to analyze Indonesia’s legal framework for online gambling, comparing it with regulations in Southeast Asia and benchmarking it against international best practices to identify gaps and recommend improvements. The study also integrates IT governance perspectives using COBIT 5’s MEA03 process to enhance regulatory enforcement. A qualitative methodology is applied, involving literature review, comparative legal analysis, and IT governance mapping. Data is gathered from legal documents, regulatory frameworks, and secondary sources, with findings validated through a hermeneutics approach and expert interviews. The findings reveal significant regulatory gaps in Indonesia’s framework, including challenges in enforcement, jurisdictional limitations, and the impact of technological advancements such as cryptocurrency. Comparative analysis highlights Singapore’s licensing system and the Philippines’ structured enforcement as effective models. Mapping with COBIT 5 identifies opportunities for improved monitoring and compliance through IT governance. It is concluded that Indonesia’s efforts to combat online gambling require updated legislation, international collaboration, and enhanced technological tools. Recommendations are provided to policymakers for strengthening enforcement and aligning regulations with global standards, aiming to create a safer digital environment while addressing socio-economic concerns.
